MindMeld Terms of Service

1. Acceptance of Terms

By accessing and using MindMeld (the "Game"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Game.

2. Game Rules and Fair Play

Players must adhere to the following rules:

• No cheating or exploitation of game mechanics.

• No use of automated tools or bots.

• No sharing of accounts.

• No harassment or abusive behavior.

• No manipulation of game statistics.

Violation of these rules may result in account suspension or permanent ban.

3. In-App Purchases

Our Game includes in-app purchases:

• All purchases are final and non-refundable (unless required by law).

• Prices may change without notice.

• Virtual items and currency have no real-world value and cannot be redeemed for cash.

• Purchases are subject to platform terms (e.g., Apple App Store/Google Play).

4. User Accounts

Account responsibilities:

• You are responsible for maintaining account security.

• You must provide accurate information.

• You must be at least 13 years old.

• We reserve the right to suspend or terminate accounts.

5. Intellectual Property

All content in MindMeld is protected by copyright and other intellectual property rights:

• Game content may not be copied or modified.

• No reverse engineering of the Game.

• No unauthorized distribution of Game assets.

6. Limitation of Liability

We are not liable for:

• Loss of Game progress or virtual items.

• Service interruptions or technical issues.

• Third-party actions or content.

• Indirect or consequential damages arising from your use of the Game.

7. User Generated Content (UGC)

Summary of Ownership

By creating or submitting content (including but not limited to custom levels, artwork, and messages) within the Game, you agree to the following:

• Assignment of Ownership: You irrevocably assign and transfer all right, title, and interest, including copyright, in your User Generated Content (UGC) to YiYi Games from the moment of creation.

• Sole Owner: YiYi Games becomes the sole owner of the UGC, and you are not entitled to any compensation or attribution for this assignment.

• Waiver of Moral Rights: You waive any and all claims to Moral Rights (such as the right of paternity/attribution) concerning the UGC.

UGC Warranties

You represent and warrant that:

1. You are the sole creator and owner of the UGC, or you have all necessary rights to grant this assignment of ownership.

2. Your UGC does not infringe, misappropriate, or violate a third party’s intellectual property rights or rights of publicity or privacy.

8. Disclaimer of Warranties

The Game is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Game will be uninterrupted, error-free, secure, or that any defects will be corrected. Your use of the Game is at your sole risk.

9. Termination

We may terminate or suspend your account and access to the Game immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Game will immediately cease. Sections covering Intellectual Property, Limitation of Liability, Disclaimers, and Dispute Resolution will survive termination.

10. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, U.S.A., without regard to its conflict of law provisions.

Binding Arbitration

Any claim or dispute arising out of or relating to these Terms or the Game (except for claims for injunctive or equitable relief) will be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association ("AAA"). You agree that all claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Game after changes constitutes acceptance of the new terms. The date of the last update will be clearly noted at the top of this document.
